§ 1 Scope of Application These General Terms and Conditions (GTC) apply to all contracts and deliveries between the Provider and his Customers via the online shop. These terms specifically cover the sale of digital assets such as LUTs and templates.

§ 2 Conclusion of Contract Offers in the shop are non-binding. For digital assets, the contract is concluded when the Provider provides the download link or sends a confirmation email.

§ 3 Prices, Payment & Delivery Prices valid at the time of order apply, plus statutory VAT. The purchase price is due immediately via payment providers like PayPal or Stripe. Delivery is carried out exclusively in digital form via download. All rights of use remain the property of the Provider until full payment is received.

§ 4 Usage Rights & Copyright All copyrights to the services remain with the Provider. Upon full payment, the Customer receives a simple, non-transferable right of use. The redistribution, resale, or transfer of raw files (e.g., LUTs or project files) is prohibited without express consent.

§ 5 Right of Withdrawal Consumers have a statutory 14-day right of withdrawal. However, this right expires prematurely once the Provider has begun performance by providing the download, provided the Customer gave express consent and acknowledged the resulting loss of the withdrawal right.

§ 6 Liability & Warranty The Provider is liable for damages only in cases of intent or gross negligence. Liability for simple negligence is limited to foreseeable damages typical for the contract. The Provider is not liable for malfunctions caused by third-party software updates (e.g., video editing suites) after the download has been provided.

§ 7 Final Provisions The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction and performance is Hamburg. The contract language is German.
